HIRE TERMS & CONDITIONS

The ground rules for hiring equipment from us: what the rates cover, how delivery works, what you are responsible for while the gear is on site, and what happens if something goes wrong. Written in plain English on purpose.

01These terms

These are the standard conditions on which Elevated Rentals Pty Ltd (ABN 79 675 740 655) hires out equipment. They apply to every hire unless we have agreed something different with you in writing.

Your quote and signed hire agreement come first. Where the quote or the hire agreement for your job says something different to this page, that document applies. This page is here so you know the ground rules before you enquire — it is not a substitute for the paperwork that goes with your hire.

In these terms, "we" and "us" means Elevated Rentals; "you" means the person or business hiring the equipment; and "equipment" means everything we supply for the hire, including ropes, remotes, blok stops, test weights, cases and any accessories.

02Quotes and bookings

A quote is an offer to hire, not a reservation. Equipment is only held for you once we confirm the booking and the dates in writing.

Quotes are based on the information you give us — equipment, dates and site address. If any of that changes, the price may change. We will tell you before it does.

We may ask for company details, a purchase order, or identification of the person taking possession of the equipment before it leaves us.

03Rates, hire periods and GST

All rates published on this website and in our rate card exclude GST. GST is added to your invoice.

Weekly and monthly rates are the standard hire periods. Longer terms, bundled hires and site-specific arrangements are quoted on request.

The hire period starts on the day the equipment is despatched or collected, and runs until the equipment is back in our possession — not until you finish using it. If you keep the equipment beyond the agreed period, hire charges continue at the same rate unless we have agreed otherwise.

04Delivery, collection and freight

Delivery is quoted per job at the same time as the hire rate, so the cost is known before you commit. There are no hidden delivery fees added afterwards.

You are responsible for providing safe and reasonable access to the site for delivery and collection, and for someone being available to receive the equipment. Costs caused by a failed delivery or collection attempt — where nobody is available or access is not possible — may be charged to you.

You may collect and return equipment yourself, provided it is transported and restrained safely.

05Checking the equipment on arrival

Equipment goes out inspected, tagged and with the certification and documentation that belongs with it. Please check it on arrival.

If anything is missing, damaged or not as described, tell us within 24 hours of delivery so we can sort it out. After that we may reasonably treat the equipment as having been received in good order.

06Using the equipment

While the equipment is on hire it is in your care and control. You agree that:

  • only competent, appropriately trained and (where required) licensed people will operate it;
  • it will be used for its intended purpose, within its rated capacity, and in line with the manufacturer's instructions and any applicable Australian Standard or work health and safety law;
  • you are responsible for the safety of the work, including planning the lift, rigging, exclusion zones and any permits or safe work method statements the site requires;
  • you will not modify, repair, dismantle or alter the equipment, or remove or deface any tag, plate, label or certification;
  • you will not sub-hire, lend or part with possession of the equipment without our written consent; and
  • you will keep it secure, protected from the weather where practical, and use it only at the site you told us about, unless we agree otherwise.

07Faults and breakdowns

If the equipment stops working properly, stop using it immediately and call us on 0401 460 688.

Where a fault is caused by fair wear and tear or a defect in the equipment, we will repair or replace it as quickly as we reasonably can, and hire charges will not run for the time you are without working equipment. Where the fault is caused by misuse, neglect, overloading or an accident, the repair is at your cost and hire charges continue.

08Loss, damage and repair

You are responsible for the equipment from the moment it is delivered or collected until it is back with us. That includes loss, theft, damage beyond fair wear and tear, and damage in transit where you arranged the transport.

If equipment is damaged, you are responsible for the reasonable cost of repair. If it is lost, stolen or damaged beyond economic repair, you are responsible for its replacement cost. Hire charges continue until the equipment is replaced or the loss is settled.

Tell us as soon as you can if equipment is lost, stolen or damaged, or if there is an incident involving it.

09Insurance

You should hold appropriate insurance covering the equipment while it is in your possession, and public liability insurance covering the work you are doing with it. We may ask you to show us evidence of that cover.

Our insurance does not cover your work, your site, or the equipment while it is on hire to you.

10Returning the equipment

Please return the equipment on the agreed date, complete, clean and in the same condition it went out in, allowing for fair wear and tear.

Missing accessories — ropes, remotes, blok stops, cases — are charged at replacement cost. Equipment returned excessively dirty may attract a reasonable cleaning charge.

11Payment

Invoices are payable on the terms shown on the invoice. Accounts are available to approved commercial customers; otherwise payment is required before despatch.

If an account is overdue we may suspend or end the hire, recover the equipment, and recover the reasonable costs of doing so.

12Changing or cancelling a booking

Tell us as early as you can if your dates move or the job is cancelled. We will do our best to accommodate a change.

Where a cancellation happens after equipment has been prepared, allocated or despatched, we may charge for freight already incurred and for a reasonable part of the hire. We will always tell you what that is before charging it.

13Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Subject to that, our liability in connection with a hire is limited, at our option, to repairing or replacing the equipment, resupplying the hire, or refunding the hire charges paid for it. We are not liable for indirect or consequential loss — including loss of profit, site delay costs or liquidated damages — arising out of the hire.

You remain responsible for the safety and supervision of the work carried out using the equipment.

14Privacy

Personal information collected in connection with a hire is handled in line with our privacy policy.

15Governing law and contact

These terms are governed by the law of New South Wales, and the courts of New South Wales have jurisdiction over any dispute about them.
